1. Acceptance of terms
By accessing or using Tidar Cashless (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Description of service
Tidar Cashless provides a cashless payment infrastructure for live events — including an organizer dashboard, merchant POS, digital event wallets for attendees, and real-time reporting. The Service is offered as software; we are not a bank and do not hold client funds outside the limits permitted by applicable regulation and our payment partners.
3. Eligibility
You must be at least 18 years old — or the age of legal majority in your jurisdiction — to create an organizer or merchant account. By using the Service you confirm that the information you provide is accurate, current, and complete.
4. Accounts & access
- You are responsible for keeping your credentials confidential and for all activity that occurs under your account.
- Notify us immediately at [email protected] if you suspect unauthorized access.
- We may require additional verification (e.g. identity, business registration) for organizer and merchant accounts.
5. Organizers & merchants
Event organizers and merchants are responsible for the goods and services they sell, the accuracy of their menus and prices, tax compliance, and complying with local laws and event regulations.Tidar Cashless is not a party to the sale between merchants and attendees and does not guarantee the quality, safety, or legality of any item sold.
Organizers may assign merchants and agents to their events; they remain responsible for the actions of users they invite.
6. Payments, fees & refunds
- 0% commission. We do not take a commission on transactions processed through the Service.
- Processing fees. Third-party payment processors may charge fees for top-ups; those fees are disclosed before payment and are governed by the processor's terms.
- Refunds. Refund policies are set by each organizer. Tidar Cashless provides tooling to process refunds but does not itself decide eligibility.
- Chargebacks and disputes are the responsibility of the receiving organizer or merchant.
7. Acceptable use
You agree not to:
- Use the Service for illegal activity, fraud, money laundering, or to finance prohibited goods.
- Interfere with, disrupt, or compromise the security or integrity of the Service.
- Attempt to gain unauthorized access to any data, account, or system.
- Reverse engineer, scrape at scale, or resell the Service without written permission.
- Impersonate another person or misrepresent your affiliation.
8. Intellectual property
The Service, including its software, design, logos, and content, is owned by Tidar Cashless and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You retain ownership of the content you upload (logos, product data, etc.) and grant us a license to host and display it for the purpose of operating the Service.
9. Suspension & termination
We may suspend or terminate your access if you breach these Terms, pose a security risk, or if required by law. You may stop using the Service at any time; certain provisions (e.g. payment obligations, disclaimers, limitation of liability) survive termination.
10. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of liability
To the maximum extent permitted by law, Tidar Cashless and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill. Our aggregate liability for claims relating to the Service is limited to the greater of (a) the fees you paid to us in the 12 months preceding the claim, or (b) one hundred US dollars.
12. Indemnification
You agree to indemnify and hold harmless Tidar Cashless and its team against any claims arising from your use of the Service, the goods or services you sell, your content, or your violation of these Terms or applicable law.
13. Governing law
These Terms are governed by the laws of the Kingdom of Morocco, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of Casablanca, unless mandatory consumer-protection laws in your jurisdiction require otherwise.
14. Changes to these terms
We may update these Terms from time to time. If changes are material, we'll notify active accounts via email or through the dashboard. Continued use of the Service after changes become effective means you accept the updated Terms.
